Terms and Conditions

NOTE: This page explains our terms of service, which contain important information about your legal rights. When you use PageKid, you’re agreeing to these terms. 

The Terms and Conditions ("Terms") govern your use of the PageKid website ("Website" or “Platform”) and the services provided therein. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Website. These Terms cover your use of and access to the sites, templates, products, applications, tools, services and features (collectively, the "Services") provided by PageKid.

  1. Account Registration

    1. In order to use certain features of the Website, you may be required to register for an account. By registering for an account, you agree to provide accurate and complete information and to keep your account information up-to-date. 

    2. You may create one account per email address. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

    3. The Services are not intended for and may not be used by children under the age of 16. By using the Services, you represent that you're at least 16. If you’re under the age of 18, depending on where you live, you may need to have your parent or guardian’s consent to this Agreement and they may need to enter into this Agreement on your behalf.

  2. User Information and Data Storage

    1.  By using the PageKid website and its services, you consent to the collection and storage of certain information necessary for the provision of our services. We understand the importance of safeguarding your information and employ industry-standard security measures to protect it from unauthorised access, use, or disclosure. Rest assured, your data is stored securely on our servers and is used solely for the purpose of delivering and enhancing our services.

    2. We do not sell or share your information with third-party clients for any reason.

  3. Use of Services

    1. The Website provides tools and resources for creating webpages ("Pages"). You may use the Website to create, edit, and publish Pages for personal or commercial use.
    2. You are solely responsible for the content you publish on your Pages. By publishing content on the Website, you represent and warrant that you have the necessary rights to publish such content and that it does not violate any laws or infringe upon the rights of others.

    3. PageKid reserves the right to remove any content that it deems to violate these Terms and Conditions, and the prohibitions detailed in section 2.4, including but not limited to content that is unlawful, defamatory, obscene, harmful, or otherwise objectionable. PageKid may suspend or remove or take legal action against users who violate these Terms and Conditions. The following is considered prohibited Content:
      You may not publish or distribute any content on the Website that:

  • Violates any applicable laws or regulations
  • Infringes upon the intellectual property rights of others
  • Contains false or misleading information
  • Is defamatory, libellous, or disparaging towards any individual or entity
  • Contains hate speech, discriminatory language, or incites violence
  • Is pornographic or sexually explicit in nature
  • Promotes illegal activities or substances
  • Harasses, stalks, or threatens others
  • Contains viruses, malware, or other harmful code
    1. PageKid reserves the right to remove any content that violates these prohibitions and may take appropriate legal action against users who violate these Terms and Conditions.

  1. Content

    1. Your content remains yours when using PageKid's services, except for limited rights necessary for us to provide, improve, promote, and protect the platform. By providing content, you grant PageKid a non-exclusive, worldwide licence to use, host, store, reproduce, modify, and distribute it for these purposes. We may feature your PageKid sites or associated content for marketing purposes, granting us a perpetual, royalty-free licence to do so. You waive any claims related to moral rights or similar rights in your content. You can opt out of being featured through your PageKid account.

  2. Responsibility

    1. Your PageKid sites may attract visitors, customers, and users ("End Users"), for whom you are solely responsible. You, and you alone, have the responsibility to  support your End Users and comply with all relevant laws and regulations regarding your sites and End Users. PageKid is not liable for, and will not provide legal advice regarding your sites, content and/or End Users. Similarly, your videos are your responsibility, and you must comply with all laws and regulations related to them. 

  3. Power-User Program

    1. The “Power-User” program at PageKid is designed for users who register for our services before the official launch date. These users will be entitled to a fully featured lifetime account and priority support.

    2. To qualify as a Power User, individuals must sign up via the dedicated form provided by PageKid.

    3. PageKid reserves the right to refuse to grant Power User status without justification.

    4. Priority support will be primarily conducted through email correspondence.

    5. All terms and conditions outlined and detailed in this document apply to “Power-Users” just like any other user of the platform. 

    6. “Power-User” accounts will have some limitations and restrictions on the number of pages that can be created and the level of traffic those pages can generate. These restrictions are implemented at the discretion of PageKid to prevent misuse of the platform. If a Power User wishes to exceed these limitations, they can contact us directly with their request at hello@pagekid.com.

  4. Paid Services

    1. At PageKid, we're committed to providing the best possible experience for our users without breaking the bank. That's why, as of now, all of our basic services are available to you completely free of charge. However, we want to be transparent about our future plans. While we currently don't have any plans to introduce fees for our basic features, we may do so in the future to support the growth and sustainability of our platform. 

    2. Additionally, some features that are currently offered for free may transition to paid services as we continue to evolve and expand. Rest assured, any changes to our pricing structure will be communicated clearly and in advance, and we'll always strive to provide you with the best value for your investment.

    3. By subscribing to our premium services, you acknowledge and agree that your subscription will automatically renew at the end of each billing period, whether it's monthly, annually, or otherwise, unless you cancel your subscription prior to the renewal date. We'll automatically bill you for the applicable subscription fees using the payment method you have on file with us, unless you opt out of automatic renewal. Your renewal period will be equal in time to the initial subscription period unless otherwise specified. You authorise us to charge you for the renewal fees and any applicable taxes or fees associated with your subscription. 

    4. Please note that we do not automatically notify you regarding your renewal. It is your responsibility to manage your subscription settings and disable auto-renewal at any time through your account settings on the PageKid platform.

  5. Intellectual Property

    1. PageKid retains ownership of all intellectual property rights in the Website and its contents. You may not use, copy, reproduce, or distribute any content from the Website without prior written permission from PageKid.

  6. Term and Termination

    1. This Agreement shall remain effective until terminated by either you or PageKid. You have the option to terminate this Agreement at any time through the PageKid platform by requesting to delete your account via email to hello@pagekid.com. PageKid reserves the right to modify, suspend, or discontinue any part or all of the Services, or restrict or disable your access to the Services, at our sole discretion and without prior notice. This may occur, for instance, if you violate the terms outlined in this document. In such cases, PageKid will make reasonable efforts to provide you with advance notice of any suspension or termination. Certain sections of this Agreement will survive termination, including but not limited to those pertaining to Your Content, PageKid's Intellectual Property, Warranty Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and any Additional Terms.

  7. Disclaimers

    1. To the extent permitted by law, PageKid makes no warranties, whether express or implied, regarding the Services. The Services are provided on an "as is" and "as available" basis. PageKid also disclaims any warranties of merchantability, fitness for a particular purpose, and non-infringement. No advice or information, whether oral or written, obtained from PageKid, shall create any warranty. PageKid does not warrant that the Services will: (a) be timely, uninterrupted, or error-free; (b) meet your requirements or expectations; or (c) be free from viruses or other harmful components.  In certain jurisdictions, some disclaimers may not be permitted under the law, so they may not apply to you. However, to the maximum extent permitted by applicable law, these disclaimers apply. You may have other legal rights that are not affected by this Agreement. Any statutorily required warranties, if applicable, shall be limited to the maximum extent permitted by law.

  8. Release of Liability

    1. To the fullest extent permitted by applicable law (depending where you are from), PageKid and its affiliates, as well as its and their directors, officers, employees, and agents, shall not be liable for any claims arising out of or related to the Services or this Agreement for: (a) any indirect, special, incidental, exemplary, punitive, or consequential damages; (b) any loss of profits, revenue, data, goodwill, or other intangible losses; (c) any Losses (as defined below) related to your access to, use of, or inability to access or use parts, some, or all of your Account, Your Sites, or parts or all of the Services, including without limitation interruption of use or cessation or modification of any aspect of the Services; (d) any Losses related to unavailability, degradation, loss, corruption, theft, unauthorised access to, or unauthorised alteration of any content, information, or data, including without limitation any related content or data; 

  9. Indemnification

    1. To the maximum extent allowed by law, you agree to indemnify and hold harmless PageKid, its affiliates, directors, officers, employees, and agents from all Losses arising from or related to: (a) your violation of this Agreement; (b) your Content, your Sites, and any other part of your business; (c) any claims by or against your End Users; (d) your violation of any law or regulation or the rights of any third party; and (e) any claims from tax authorities related to your operations and/or conduct.

  10. Governing Law

    1. These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions. Any disputes shall be settled in a court of law in Tel-Aviv, Israel.

  11. Changes to Terms

    1. PageKid reserves the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the Website.

  12. Events Beyond Our Control

    1. We are not in breach of this Agreement or liable to you if there is any total or partial failure of performance of the Services resulting from any act, circumstance, event or matter beyond our reasonable control. This may include where such results from any act of God, fire, act of government or state or regulation, war, civil commotion, terrorism, pandemic, insurrection, inability to communicate with third parties for whatever reason, failure of any computer dealing or necessary system, failure or delay in transmission of communications, failure of any internet service provider, strike, industrial action or lock-out or any other reason beyond our reasonable control.
